The Palestinian Cabinet called on Israel to destroy the synagogues left behind after the evacuation of the Jewish settlers from the Gaza Strip colonial settlements, after the Israeli Supreme Court ruled on Tuesday that the Jewish synagogues there shall be preserved and not demolished, thus maintaining an Israeli Trojan Horse that might delay the withdrawal of the Israeli Occupation Forces (IOF), scheduled for September 15, from the coastal strip.

The Palestinian cabinet in a statement issued following a meeting in Gaza City on Tuesday “demanded that Israel demolish the synagogues in the settlements, or move them.” It said this was “because there is no justification for these synagogues to remain there.”

Israel's Supreme Court ruled on Tuesday that the Jewish synagogues in the Gaza Strip will be preserved and not demolished and ordered Ariel Sharon to “issue official requests” to the Palestinian National Authority (PNA), the United Nations and the US President George W. Bush to protect them.

There are some 38 synagogues, which the illegal Jewish settlers left behind after their evacuation from the Gaza Strip.

According to the court ruling, Sharon should “issue official requests to different authorities (the Palestinian Authority, the secretary of the United Nations and the president of the United States) in order to ensure that with the transfer of all of Gaza to Palestinian control, the synagogues will be preserved and not demolished.”

The Supreme Court originally ruled the army could demolish the synagogues that could not be taken down and moved.

Tuesday's court ruling by the seven-judge panel came after Israel's chief rabbis ruled that it is forbidden to demolish synagogues. The country's two chief rabbis are the country's top authorities on religious issues.

Israel's High Court accepted the rabbis' argument that under Jewish religious law, it is forbidden to destroy synagogues.

The judges urged the government to make a formal request very soon because of the imminent Israeli withdrawal.

Palestinian Prime Minister Ahmad Qurie told his cabinet on Tuesday that Israel would remove its occupation forces from the Gaza Strip by September 15.

Qurie “has confirmed that the Israeli withdrawal from the settlements of the Gaza Strip will take place at the latest between the 13 the 15th of this month,” the official news agency WAFA reported.

An Israeli Trojan Horse

Under-Secretary of the PNA foreign ministry Abdullah Abudllah said any synagogue remaining in Gaza after the Israeli withdrawal would be used as a “pretext” to retain a foothold and intervene in Palestinian affairs.

“This is a very sensitive issue. We are Muslims and our religion and traditions don't allow us to desecrate or destroy places of worship,” he said.

“But we feel the Israelis are trying to entrap us by leaving these places intact and then tell the world 'look, the Palestinians are destroying Jewish holy places, the Palestinians show no respect for Jewish holy places,” Abudllah told aljazeera.net.

Abdullah said Israel should dismantle all Gaza synagogues and transfer them to Israel and not try to get the PNA involved in its internal problems with the rabbis of the settlements.

“We are willing and ready to help the Israeli government and army dismantle these places respectfully and with dignity,” he added.

Erakat: PNA ‘In Very Difficult Position’

The Israeli court ruling has put both the PNA and the Israeli government “in a very difficult position.”

Palestinian chief negotiator Saeb Erakat said the PNA doesn't want responsibility for the buildings. He said if the Palestinians knock down the buildings, they will be subject to fierce Israeli criticism. But if they are left standing, Palestinian protesters might try to ransack the structures.

“This will put us in a very difficult position. If we demolish them we are doomed, and if we don't, we are doomed,” Erakat said.

Erekat said that Israel has not yet made any official request to the PNA and he expected Israel to deal with the problem and not leave the synagogues intact.

“The point is we respect Judaism, Jews [and] synagogues but at the same time we don't have a single Jew in Gaza,” Erakat indicated.

Disposing of the settlements and all that is thereon is Israel's responsibility, he said, adding: “We are overloaded with complexities. We ask the Israeli government to handle the problem.”

Erakat made his remarks in a joint press conference held with visiting Spanish Foreign Minister Miguel Moratinos in the West Bank city of Jericho.

Gissin: Court Ruling Creates Problems for PNA

The Israeli government agreed that the court ruling would create problems for the PNA.

Sharon's spokesman Ra'anan Gissin said that the government would have to respond to the court but he expected that in the end, the synagogues would be destroyed for the sake of the PNA.

“They (the PNA) are incapable, unwilling to protect the holy sites,” said Gissin.

“The desecration and defiling -- jumping and dancing there -- would be much worse than if we dismantle them ourselves,” he added.

If the synagogues are left in place they would become a “point of contention” and a rallying point for radical groups, which would force the PNA to come into confrontation with the radical groups, he said.

“We shouldn't give any excuse to stir up radical emotions and hatred [among the Palestinians],” he said.

Gissin dismissed the argument that Israel's demolition of the synagogues would set a negative international precedent, saying that protected sites around the world would remain protected.

Israel Cites International Law, UN Resolutions

Jewish rabbis cited United Nations General Assembly resolutions to preserve the Gaza synagogues.

One such resolution, from 2001, calls upon all States to “exert their utmost efforts to ensure that religious sites are fully respected and protected in conformity with international standards and in accordance with their national legislation and to adopt adequate measures aimed at preventing such acts or threats of violence.”

But Gissin said, “The Palestinians don't respect their own law -- [How can we] expect them to respect international law?”

Attorney Gilad Corinaldi, who represented the rabbis, welcomed the court's decision.

“Leaving the synagogues standing will be a badge of honor for the Supreme Court, for the basic rights of individuals and communities, for the protection of cultural and spiritual treasures of the Jewish nation and will prevent the dangerous precedent of the destruction of synagogues at the hands of Jews, that is bound to have disastrous consequences on Diaspora Jewry,” said Corinaldi.

Gissin and the rabbis ignored Israel’s record of non-compliance with the UN resolutions and international law.

More than 450 Palestinian towns and villages were leveled to earth along with hundreds of Muslim mosques since the creation of the Jewish state. Dozens of the remaining mosques were either neglected, desecrated or turned into other daily life purposes, including eating, drinking and dancing.

A latest example: A Palestinian Muslim mosque was turned into a Jewish synagogue and religious school in the northern West Bank village of Sanur, near Jenin, on the lands of which an Israeli colony was built before it was evacuated from the settlers in August.
